No warranty will be valid if the defect was caused by customer’s negligence, abuse or mishandling. All merchandise sold by Upshift Performance LLC is only subject to manufacturer’s warranty and conditions. Manufactures warranty is subject to submission to the manufacturer for inspection and approval for repair or replacement of merchandise. The customer, however, will be responsible for all shipping and handling fees. No labor or inconvenience may be included in any warranty claims. There is no warranty on lights, light bulbs, decals, electrical parts, and engine parts.
All products sold by Upshift Performance LLC, unless otherwise stated in the item description, are sold in '”as-is new condition”. All engine modification components, except those that are exempt by local laws, are intended for OFF-ROAD use only. Federal and many state laws prohibit the removal, modification, or rendering inoperable of any device or element of design affecting vehicle emission or safety in a vehicle used on public highways. Violation of such laws may subject the owner or user to a fine or penalty. Installation of this part may void the warranty coverage, if any, on your vehicle. Vehicles modified by the use of performance parts may no longer be lawfully used on public highways. The customer/user assumes all cost and risks associated with these and other parts purchased from Upshift Performance LLC.
In the event legal proceedings are required to resolve disputes or indifference's, all claims and filings must be made with the New Braunfels Municipal Court located in New Braunfels, Texas. Customers will acknowledge and agree to this stipulation once the transaction has been made with Upshift Performance LLC. As a security precaution, all IP Addresses will be recorded for each completed web transaction. It is the responsibility of the customer/installer to verify the correctness of size, part number and application of all parts before installation.
We accept the following forms of payments: Credit Cards, Debit Cards, PayPal, Affirm/ShopPay, Google Pay, Venmo.
Upshift Performance LLC will ship your order based on a selected preference using the fastest, most economical method available. Orders are not shipped on Saturday or Sunday. We cannot guarantee when an order will arrive. Consider any shipping or transit times offered as only an estimate.
Import duties, taxes, and charges to Canada are not included in the item price or shipping charge. The shipping rate generated at checkout is only for transit costs.

LOST / STOLEN / DAMAGED ITEM
Your order is complete once the shipping company states that the package has been delivered. If a package is lost contact the shipping company to open a claim and then contact us. In the event the item/package was damaged during shipping, please take pictures and contact us immediately. In the event you are unwilling to assist us then you absolve Upshift Performance LLC of any responsibility for the package.
Upshift Performance LLC is not responsible for items that are lost or stolen upon delivery to the shipping address requested. Please be sure to verify that the shipping address requested is accurate and secure.
You are responsible for contacting the shipping company and us within 48 hours of delivery for lost or damage claims. Upshift Performance LLC does not refund or reship items for claims that are denied by the shipping company.
SPECIAL ORDER AND USED ITEMS
Special order items are not normally stocked and cannot be canceled, returned, or exchanged. NO EXCEPTIONS. Upshift Performance LLC is not responsible for any fulfillment delays. Refused shipments sent back us do not constitute the right to a refund or credit. It is the customer’s responsibility to make all arrangements with Upshift Performance LLC and the shipping company to receive the item upon delivery. The customer will be responsible for any freight charges associated with the shipment.
All used parts are sold AS-IS and condition and/or missing components will be stated on the listing. No refunds or exchanges.
SPECIAL HANDLING ITEMS
These items are large items such as, but not limited to certain, Exhaust systems, bumpers, hoods, trunks, spoilers, seats, and roll cages. These items incur higher shipping costs. Discounts or promotions on freight charges do not apply to special handling items. Some large or heavy items may need to be shipped by a freight company. These shipping rates will be made available at checkout. For items that ship freight please note delivery time can be lengthy.
ACCURACY OF BILLING AND ACCOUNT INFORMATION
We reserve the right to refuse any order you place with us. We may, in our sole judgment, limit or cancel quantities purchased. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.
You agree to provide current, complete and accurate email, billing/shipping address, and payment information for all purchases made on our website. If inaccurate information is provide Upshift Performance LLC is not liable for delay in transit, added shipping costs, and/or lost of packages.
